dobboy 231 2 Cars Posted May 4, 2017 What do you think chaps? Early November last year I had a look at my nephews car for him and did the brakes on it, as there was very little! (Pug 106 ~55k miles on it). I took it to a MOT centre to a guy I kinda know, and he phoned me and said the beam was knackered, come and collect it. (But never Failed it or Passed it) So, I got a replacement reconditioned beam ordered up. I was busy so I got another guy I know to change it over, then took it back for MOT and it past with no advisories. So last Tuesday, my nephew sold the car for £500 or so. The woman came with a guy to look over it for her, and they left happy with the car. Last night, the woman he sold the car to came back to his door and said she had had a garage look over it and it's not road worthy, there is rot/rust on the chassis, the beam doesn't look new, and it's going to cost £800-900 to put right. She was asking who the previous owner was before he bought it, and where it had been MOT'd in November '16. Thankfully my nephew just acted daft and pleaded the 5th amendment! and she eventually left. Now I know for sure the beam was done as I ordered it etc, seen the old one coming off, and sent the old one back by courier etc etc. The car was a bit crusty underneath when I done the brakes but it's a 2001 car so should be expected. What i'm a little concerned about is that she somehow tries to confront or get my MOT man into bother as he never identified any advisories. I've had a look at the previous MOT from a totally different garage and it has no advisories identified either, and it's only done ~5k miles between MOT's. Looking on the Gov site it states (complaint about it passing) "Time limits If your vehicle passed, you need to complain within: 3 months of the MOT if its a corrosion-related problem 28 days for other defects You can take your own action against an MOT test centre through Trading Standards, personal legal proceedings or reporting the centre to the police. DVSA cant help you take action against a centre. " I've told my nephew that if she appears again to tell her to GTF/Sold as Seen/don't come back. I think this new garage she took it to for a look over might be taking the piss, but i'm not sure, it may well be rotten but it definitely has a new beam, decent brakes, new exhaust, and everything works on it. Do you think I should be pre-empting her causing hassle and warn my MOT man, or just forget about it? It's nearly 6 months since the MOT and been over a long winter. What do you think? ALEX 98 1 Cars Posted May 4, 2017 I wouldn't dream of going back to a private sale asking for a refund. Even if the person selling the car intentionally tried to hide the fact the car was a lemon. I'd still feel it was my fault for not spotting the problems before I handed over the cash. Forget about it and ignore her. Biggles 65 Posted May 4, 2017 My MOT says the DVSA like to see advisories. Hence it's not compulsory to note them. MOT'd 6 months ago - I've had cars go from "sound as a pound" to "duck me where's the chassis rail gone" in that sort of timeframe. MOT station / DVSA will quote the 3 month rule so no worries for your MOT man. Sold as seen (and inspected). Caviat emptore as they say. 1 Share this post Link to post Share on other sites

Gaz205 50 Posted May 4, 2017 Have you put the car through the .gov mot check to see what advisories it's had over the years? If it's never had corrosion issues raised then the tester is being very friendly or its nothing of any concern ... Private sale, sold as seen. Let them complain to the tester. GLPoomobile 958 Posted May 4, 2017 There's no predicament so far as I can see. Tell your MOT man and he'll probably shrug his shoulders and get back to doing his job. I see two possible motives. Number 1 is someone close to her has had a look underneath it, formed an opinion and tried to influence her in to seeking some money back. Unlikely thought if she didn't seem interested in any refund. Number 2 is, she's taken it to a dodgy garage to get something done and they are trying to get some more work out of her, telling her it's unroadworthy, and she's decided it's the MOT tester that needs to be confronted rather than the seller. The garage sells cars, m I spoke to my sister in law tonight, she said if she comes back they weee going to give her £100 back. I told her not to be daft.
