Mot Failure?

Took a wheel off the car today and discovered that I have a couple of speed holes in the front panel.

 

Now I do actually have a repair section to replace this, but I'm just curious - has anyone had a car pass the MOT with holes like this? I don't believe the holes are within 30cm of a suspension mount, and I have a feeling pretty much all the front panel is not a "prescribed area" but I wonder if anyone has had actual experience with this?

 

I will be repairing the area regardless.

I'm an MOT tester and if it wasn't with 30cm of the strut i would pass and advise it.

Depends on the vehicle. If i find a match it's tested as a cat, if i don't, it gets a basic non cat test.
