Disabled Bay In Residential Car Park

If it is a private car park/building then probably not?

 

All this thread makes me glad I don't live in a place with communal anything to be honest!

I'd just assume the council may have been aware of an application to create the designated space for a resident, erect signage etc perhaps. I don't know, but it would be worth a quick call to the council IMO.

 

There's a portion of land on my estate which is presumably shared by several houses as off road parking (nobody really uses it to be honest!). It's not divided into specific allocated spaces per household and there are no lines, but would have been added when the houses were built in the late 80s by the developer. I wouldn't have a clue who would have a say if I was to leave a legal and up together car there as storage. It's always intrigued me who would be responsible any upkeep to the area.

I haven't re-read, but I think you'd said the neighbour had put up a sign about being for disabled badge holders, even though they dont have one? if so, get someone to make you a legit-looking warning/penalty notice (with your local council's logo etc) for parking in a disabled space with no blue badge, and then pritt-stick it to their car window. Admittedly it probably wont achieve much, other than amusing you and worrying the neighbour that's made the whole thing up!

Check with the landlord or management company to see if they run the car park or someone else does and whether they put the disabled only sign up. If they did, ask them to contact the family that park in the reserved space to display a badge as the sign demands (even though a badge only officially applies in public areas, the company running the car park have required it). If the family refuses to display a badge as required by the landlord/management company or they put the sign up themselves then park there if you need to.

 

Might also be worth checking the deeds to their property as it will need to state any reserved car park space and which one. If it doesn't, you have just as much right to park there as they do.

 

Don't feel harsh either. The vast majority of disabled people wish to be treated equally, if not all. Plus, if the family genuinely needed the space then they'd have no trouble doing what's needed to reserve it.

Parking bays marked as "Disabled Parking" on private land are entirely down to the landlord/factors. The council will NOT be involved unless its council owned property and land. A bay can be painted and posted "Disabled Bay" via a legitimate request by a resident to the landlord/factors, they'll send bodies out to paint it up. The space is only marked as a disabled by the landlord/factor to encourage other residents to be courteous. However, because it is not council owned property and has not been marked by the council, a blue badge does not need to be displayed either when she or anyone else parks in that space.

In other words, you can indeed park there and tell her to get stuffed unless she can prove shes a bona fide blue badge holder. Her non-existent daughter doesn't count, she is not a resident. If the markings are faded it is possible a previous resident did the above and moved out, and the old bag your dealing with opportunistically claimed the space as her own, feigning disability to acquire a free private space. Get her to show you her blue badge, make sure it has her face and details. I doubt she has one judging from her confrontational attitude.

 

This above is the case in Glasgow but it's highly likely to be the same UK wide.

That is all well and good but the fact is you still have to live there. Personally I like my cars without key marks down the sides. Unless parking is a massive issue getting a spot then I'd let it ride. Plus it also means should you want to keep in future let's say a 205 GTI in a space as well as your other car, they will be straight into your case about it.
