Disabled Bay In Residential Car Park

Now I just want to say I would never park in a genuine disabled bay and people who do so anger me.

 

A bit of background - I moved into my property back in 2007, there's an off road carpark that we all share. The day I got the keys and was showing my parents round a neighbour appeared and told me a disabled bay was theirs as they paid for it and please ensure I never park in it as it's needed for her disabled daughter.

 

(I wasn't in it at the time)

 

The paint on the bay was fairly warn out even then and no signs anywhere. They have never had a blue badge in any of their cars and in all this time have never seen this alleged daughter despite bumping into them most days.

 

I've never parked in the bay until a couple of weeks back when I left into car in there for a couple of hours as there were no other spaces and it was hacking down.. I thought sod it they don't display a badge ever and the markings are now pretty much gone, if it's wet they can't be seen at all.

 

I get a knock on the door saying please move your car from my space. I mentioned it wasn't actually her space and got the story again.

 

I couldn't be arsed to argue so moved it to the road.

 

Now a sign has now gone up saying blue badge holders only and they continue to park there without displaying a badge.

 

The lines have not been repainted at all.

 

Looking online official signs appear to say "display disabled badge" and this one just says "blue badge holders only" the signs can be bought online it seems. Also I believe the council won't charge for genuine bays.

 

Would you report them to the council as not displaying a blue badge or would you enquire as to if it was a genuine bay or not? Or just leave it?

 

I know it seems petty but I don't see why they should have exclusive use of a space if they don't deserve it.

How much parking is there?

 

Is it a regular problem?

 

You may find it is not an official space and then, legally, start to use it. Then you come out one morning and find you car keyed on every panel.

 

Annoying as it is.

Minefield.

My thoughts:

It seems even if it isn't a true disabled bay they think treat it like it is, so they won't roll over easily.

 

But if it's worth the hassle to you (iplod's comment), then I'd inquire with whoever owns/runs/maintains the car park to see if it is a valid space.

Then you can decide where to go from there:

1) report them and watch them get fined (hopefully) for parking in a bay without a blue badge.

2) you start parking there with a small blue badge saying "fook off this isn't a defined disabled space" (maybe even stick a copy of the letter/email confirming this).

 

And if their disabled daughter doesn't live with them I very much doubt that they could be 'given' it ("it's theirs") whether they paid for it or not.

And if she's moved out then they would have to give the entitlement back.

Oh - and their blue badge (if indeed they ever had one).

Seriously if it is legitimate then fair enough, if not then ask them why they think they have had a right to take your rights away.

As far as I know, blue badges and disabled spaces only apply to council run areas, not private car parks. I'm not saying you should stick two Vs at them, but you can't be fined for parking there.

 

If I were you I'd enquire with who ever runs the building as to whether the spaces is reserved solely for your neighbours, or if it's a space intended for anyone with a disability. If they genuinely need the space for their disabled daughter, then it's probably not worth causing a fuss, but if they are claiming it's their right to park there when it isn't, then there's no harm in putting them right!!

I personally would ask all my friends and family if they had a 'Blue badge' that I could borrow for a bit. Then park in the space.

Out of 20 odd spaces at our local ice rink, 8 of them are disabled bays.

 

 

 

An ice rink...

Over the last few years Clacton council have completely gone mad. There must be 2 spaces for every disabled badge holder, along with Taxi ranks, Bus stops, and finally Loading bays it is no blxxdy wonder why town centres are dying.

If they want to play nasty get nasty people get so so so hung up on that's my stuff it's like a small child having a toy they don't use but won't let another child play with it as it's theirs no one else's!

 

Let me guess is this space nice and close. I'd buy a 100 pound car and park it there just because.

I'd look into the legality of the sign with the authorities then I would make it my life's goal to f*** with this person. I say that because I highly doubt the sign is legal and it sounds like they took an aggressive stance right from the off (which means they are arseholes). I bet their daughter (who probably never visits because they are arseholes) is just a fat bastard and not actually disabled. I'm f***ing fed up with how neglecting your body to the point that your spindly little under used legs will no longer carry your fat ass entitles you to a blue badge, a nice cheap motor on motability and a professor X scooter for driving round collecting your supply of fat fuel.

 

Might have had a small beers but this person sound like a total d*ck.

Rich_P ran this same topic on a BMW forum and it went to 7 pages of abuse, name calling and threats over parking in disabled spaces and parent and child spaces before it got locked by a mod.

 

It's amazing how different the response here is.

From memory disabled bays only apply to provide access to public amenities. So I think its fake, keep parking there and see if you get a ticket :)

 

If you do you can take photos of the sign and just put a 'blue badge' of any description in the window.

 

If it concerns you greatly I will speak to the road traffic section in work and find their response to your scenario

As mentioned I did post this on a BMW forum and was quite suprised how people responded.

 

I didn't agree with a lot being said on there that's for sure.

 

 

I've not done anything about it yet.

 

I still thinks it's not right if they are pulling a dodgy one but am not sure if I can be bothered to get into disagrements with them.

 

I'm still paranoid my new car will end up being targetted!

Some neighbours can be completely unreasonable. My advice would be to avoid the situation where possible and park elsewhere. In the event you have no alternative, park there and explain you'd be happy to move if required and reiterate you won't be making a habit of it.

 

I've some neighbours who are very awkward, but what I try and do is not give them any reason to make my life any more difficult than it currently is. I've a middle aged family next door who will put a police cone outside so people can't park alongside their house for pete sake. If we were to park nearer to their house than ours, the father will actually park about 3mm from your bumper blocking his own drive to make a point. Funny thing is, if a car is parked in the space he likes, he will park outside our house, effectively doing to us what he hates - but will I block him in to give him a taste? No, because I want the upper hand - plus I've got enough off road parking for about 6 cars to his measly single parking space. Back of the net.

I'm currently having a argument with my gay Neibour about a parking space fiasco. Not that the guy owns a car or is ever there but is adiment I've parked in his space...even though I can't due to him putting a Bullard thing there. Oh and the face my car does not leak oil but the other neibours new and posh car does!!!!

 

There are some mahooooosive bell ends in this world!

So that's why you bought that house!

 

Yeah asically the land for a suburban estate was the reason I purchased it. There's a 7 metre waste of space to the side so I'm going to add a double garage onto the single that's already there.

 

For nearly 5 years I walked past it daily wishing it was for sale as it had potential, and then one day bingo a board appeared :D The couple had been there 25 years from new!

I never understood the 'dont park outside my house' mindset, these people would quite happily drive into any town and park in a 'free' space without sparing the same thought for the people who live next to those spaces.

The guy that lives above me has mentioned he had a similar disagreement in the past.

 

It looks like one of the flats has now been vacated and the 2 transits (makes it sound pikey round there but it's really not!) and the audi they had for a 1 bedroom flat are now no longer in the carpark so parking hasn't been an issue the last few days so I'm inclined to just leave it until it becomes a real issue again.
