ok i was on my way home from work when i was stationary in my car about 500 yards from a aroundabout when i was struck from behind at about 40mph and even tho i had my handbrake on i was pushed forward about 6yards the car what hit me was clio and was f***ed my car was tailgate,bumber,back panel etc,anyways on my way home i started to get a pain in the back of my head and pain also in my back so on the advice of my girlfriend who is a nurse went to hospital to get checked out who did some basic tests and gave me some co-codamol 30/500 pain killers,anyways i get back home and the ladys insurance phoned me and offered me £1000 on the spot which i declined as i havent been in this position before and it looked to me like they wanted to get it sorted ASAP,so afew days have now passed and in the mornings before my drugs i cannot even put my socks on and even going for a s*ite is hard work,the insurance company have now offered me £1200 and i dont know what to do.so has any one been in a genuine claim and can advise me as i dont know what to do

There's no way you can accept a (presumably) full and final payment yet - you don't know if the injury will last a week or two or years. Don't agree to ANYTHING yet. If you've got legal cover with your insurance, ring them. Get to a chiropractor, get them to write their opinion out formally, and keep their invoices. Claim those back. If you have to take time off work, keep full details. Keep everything, down to receipts for the cost of prescriptions. Keep notes on every appointment, letter and phone call you make.

 

There's a lot of utter pee-takers when it comes to whiplash, and the insurance waving instant money at them will get them out the way as quickly and cheaply as possible - but for a genuine injury (and being taken up the chuff at 40mph is a damn hard impact), it's a very different kettle of fish.

it was a total shock,the first thing the lady said to me was oh my god im so sorry i wasnt concentrating as my boyfriends just been found dead,i tried to help her best i could as she was in a right state but like i have said her insurance wanted it resolved but as the days go by my back seems to be worse aslo my elbow to wrist is in pain,you see them people on tv with claimlines but i dont know if there genuine or not

Not a great day for her, then... But p'raps she shouldn't have been driving? It's b'sides the point. All that matters here is that she's admitted complete liability. That's great - the best possible situation. (Not that she could really do anything else, but...)

 

WRITE to her insurer. Tell them that you WILL be claiming, but that you need to know the extent of your injury first, including the duration. Tell them that you will keep them informed. Get them to confirm in writing that they're in agreement. Get your GP to refer you to a chiropractor, and get them to write a report for the insurer. Send that through. Show them that you're genuine, not a chancer, and they'll relax a bit.

 

You've got a genuine injury. Your first priority is to get it sorted out, medically. THEN and only then, negotiate a figure that's fair compensation for the pain and inconvenience you've suffered. No more, no less. Step away from the No-Win-No-Fee-As-Seen-On-TV scumbags.

Never been in that situation, but listen to yer man above, he talks sense ;)

 

Absolutely no point in going off half cocked, getting a grand or so for your injury now, and then finding out after the fact that your injury is a lot more life affecting than you first expected. And don't entertain the ambulance chasing injury lawyers either, they're only out to a cut of the settlement for themselves. You pay for insurance (presumably) so get them involved and working for you, that's what they are supposed to be there for.

Shes admitted liability to you but may be a diffent story when she speaks to her insurance comany, did you take pictures of the scene? you can usually tell by the marks on the road that you was there with your parking brake on as it would have left a black line on the floor, unless it hit you that hard that it picked the wheels off the floor

no i was with her when she was talking to her insurance and she admitted she wasnt concentrating and just ran in to the back of me,she never even skidded just hit me full wack.i have an appointment with my doctor on thursday so i will take it from there as i dont know what my injuries are and with out the pain killers the hospital gave me it would be worse but i dont want to be taking pain killers all the time

I was rear ended in my Fiat coupe last summer by some stupid Who$re in a fake mini.

 

She gave fake details at the scene but I was able to remember her plate.

 

Go by the book don't accept there offers, write everything down get police reports bills for all expences. If her insurance are offering you that to settle this quick they know you are due more. (C^%Ts

 

You have done nothing wrong so don't feel guilty to take them for a good wedge. Also don't be rushed in to accepting an offer.

 

I went through a no win no fee agency. It took 5 months to get sorted, but I ended up with nearly 3k as I was injured and my car was damaged through no fault of my own.

You are in no hurry to claim for your injury. There is a three year limitation period. Just make sure you are ok for now. Any good firm would ensure you see enough experts to fully investigate your injury before negotiating a settlement. I used to work in personal injury so let me know if you have any questions or want advice on a firm to choose. You don't have to go through your insurance legal cover. Those firms are usually terrible.

Don't accept anythimg until you've at the very least seen your GP. Explain to him as honestly ans as detailed possible exactly what your symptoms are.

 

Whiplash is a pain. But very commonly claimed for when it's non-existent too.

 

The reason they're trying to make you an early offer is just to save themselves money and time. They're also testing you. My whiplash lasted a couple of weeks when I was rear ended. But my back problems went on for years and I still get a few little problems.

 

Get yourself better before you even consider thinking about claiming.

As per all the other comments really, wait and see how it unfolds. Avoid the "no win no fee" companies and use your insurance company if you have legal cover. If clears up quickly and causes you no really issue then consider not claiming at all!

I'd have to agree with the comments above - but not about a Chiropractor as they are not medically qualified so doubt their opinion counts for much in a court of law. There is a reason why you don't get Chiroprators on the NHS!

 

But yes to a GP and possible other refferal.

Get to a GP and get a referral. If you suspect you have a back injury DO NOT go to a Chiropractor. Get a MRI to see full extent of the injury.

 

My wife had a lifting injury at work some years ago working in a care home which wouldn't supply the staff with lifting equipment.

GP sent her to a Chiropractor for an appointment which made the injury worse.

Finally had an MRI scan which showed a slipped disk which resulted in a surgical discectomy which resolved the back pain.
