Are My Brand New Shocks Broken?

Just received my brand new Group N Billie shocks and noticed some oil around the top of one of them. Further inspection shows what appears to be a small crack as seen in the photos. I can't separate the crack further by pushing on it, so I'm not sure if it actually cracked?

 

What do you recon?

I'd not be impressed if they were sold to me as brand new.

 

Looks like a crack in the second pic to me.

I bought them on ebay through a well known rally company. I won't name and shame or anything like that, as I'm sure the problem will be sorted without too much of an issue. i simply wanted to confirm my fears before getting back to the seller.
