I'm really sorry to hear whats happened to your fine 205 but at least you are ok apart from the stress of it all.

 

Whether he said 80/90 mph or not, im sure that's not what he'll say to the insurance company, it sounds like hes using scare tactics on you because he knows full well its his fault the little fu*king tw@. I bet those friends of his are his taxi buddies, did you check if there are any camera's around the roundabout, im sure the police can check if these people were somewhere else at the time of the incident maybe ?

 

It could end up being 50/50 or in his favour if he says he has more witness's than what you have.

 

I really hope it works out well for you, its not that long since that car par incident is it ?

Pretty sure there are no cameras around that area. That other car park claim is still going on !

 

I'll take this guy to court if I have to.

You have to fight, harrass, make phonecalls send letters and emails etc to get anywhere but it will be worth it in the end just to show that taxi driving Pr*ck.

Some years ago, I turned across into a T junction before a speeding car. Even had 4 witness' saying so, but my insurance didn't have any of it as it was his right of way regardless of speed. So, just make your case that you were in the right.......roundabout etiquette is pretty clearcut.

s*it luck mate, but glad the damage isn't too severe and you're ok. As people have said you can keep the car, just make sure you're very direct with the insurance company about what you want and how much you're willing to accept as a total loss (write-off).

 

Ps, you've never met the person who was following you round the roundabout. I don't think insurance companies pay as much notice to witnesses who are friends / families.

Good luck with this and sorry to hear about it.

 

I had a roundabout shunt with someone in the wrong lane and my witness (who saw it and provided his details) was invaluable. I agree that the guy following you has never met you before and just stopped at the scene as you were so obviously in shock and he wanted to assist you!

 

I got a cash settlement and got to keep the car without anything being recorded against the vehicle. A word in the ear of the accident inspector was all it took. Some welding by a mechanic friend and its (almost) as good as new, I ended up £700 better off and my boot floor is much more solid than it would have been before.

just to add my g/f just had her car writen off and bought it back for £45 it was 10% of the value of the car, had to fight to get it up from 350 to 450 thoe.

it is your choice now for buying it back i was told by estimator that came out,

 

also i had a capri that was crashed into by a police car of all things and they were going to wright it off but the garage had already started fixing (rolled it in the gargae and took a pannel off it) it so they just paid up and let us put it back on the road, was a good few years ago now but just thought id mention incase its a way to get yours done.

Unfortunately I have had a couple of similar incidents over the last few years. As said stick to your guns and don't be bullied into something your not happy with.

 

One thing, did you give the other party your address and/or phone number? I think it is worth pointing out that you are under no obligation to give this information out the only thing you have to give is

1: name of driver.

2: name of insurer.

3: registration number of car.

 

It can speed things along if you give additional information but if you have an "A hole" as in this topic I would not.

Just got off the phone with the insurance company, and because I have access to another vehicle, I was told they wouldn't need to send an engineer out to look at the car. I can just get some estimates and forward them on.

 

I'm trying to work out if that's good or bad....I think it's good :)

that means they are too cheap to assess the damage and find you a quote.

 

Once the blame is settled, you may get an assessor from the other company coming round.

But surely they will just assess the car as badly as possible ?

 

Now my only trouble is getting the car to a bodyshop for quotes. I think my local one do free collection/delivery, not sure if they send out inspectors though.

It's a little more scientific than that, but not much.

 

They will asses the condition of the vehicle, value it as prior to the accident, and or accept what the agreed value is, tot up how much they think the damage is going to cost to repair. They will have a laptop with some software on... that does all of the basic valuation.

 

If repair cost exceeds 60% of the agreed vehicle value it's cat D'd.. so this is where agreeing on an accurate value is important... photos of the car in it's best condition (not on track i might add) will always help.. evidence of how well maintained it is, new parts bla bla bla, they are contributory to winning a higher value. Demonstrating it's a really good example of a rapidly rarifying modern classic.

 

there is always scope to negotiate, if you get nowhere face to face take his email and send him adverts and write a nice bit about them.

 

 

For example, the original value for my first pug was 650, but i got 1250 out of them after sending some adverts of other MI 16s... bearing in mind that certain details that we understand to add value, you will have to teach him about. In my case he didn't realise the engine conversion significantly increased the value of the car.

 

The door on the second pug was going to cost 400 and therefore would have been border line write off as it's a shed, I told him all i was going to do was buy another door, get it sprayed and fit it, actually i told him i already had a door... he resolved to give me the money to get the door sprayed as a cheque. I pushed the dent out with my foot...

Insurance companies normally go for who was on the roundabout first, regardless whether they were indicating or not.

 

If you were on the rounadbout first you all good.

 

A woman pulled right in front of a boy I know without indicating on a roundabout, apparently it was the boy's fault as he was suppose to be giving way to any one on the roundabout.

shine him on, get him on your side, offer him a cup of tea, drink etc, especially if it is cold.

 

be nice, ask his opinion, gauge how much he knows about 205's, have your adverts and photos of the car at hand.

 

remember you'll get a second bite at the cherry when you send him "those other adverts" you don't have to hand.

 

play the game my good man.

What an absolute kick in the c**t. Keep fighting it though as I did, the insurance I was dealing with eventually got bored of my constant ranting and emailing! Saying that mine was only a cat c.

 

You can always keep the car and repair it if there is enough sentimental value.

 

Any idea what the pay out will be? They tried giving me £350 + the car, i told them where to go and emailed them links to genuine French, and Rally prepared Rallyes all £2500+ haha :)

If you really want the car?, imo that is Cat C NOT B and you are able to get them reclassified. Would be worth getting another inspection by an independent Engineer as a last resort if you are unable to talk them around, simply do not send the V5 to the insurers until you are happy with the settlement.

 

For reference, my MI205 got valued at £393 (this was in 2005), I wrote a letter of complaint to the company the engineer was from, stating they had no idea of the market value of these cars, as these are now classics rather than standard bread & butter cars, therefore glasses price guide is not realistic and inaccurate. Five minute conversation with another engineer of the same company and they adjusted the valuation to £2K ( The shell was in fair condition therefore I thought this was a good offer, if it had been a tidy shell I would have pressed for more).
